No new photos? Holmes’ defense attorneys claim government violated pre-trial gag order
Attorneys for accused Aurora theater shooter James Holmes claim that the government twice violated a judge imposed gag order by releasing a new mugshot and details of the notebook mailed by Holmes to his Psychiatrist.
The new mugshot depicts Holmes without the now infamous bright orange mop hair. Defense attorneys claim the photo was improperly leaked to the media by the Arapahoe County Sheriff’s Department September 20, the same day Holmes got the haircut.
The notebook mailed by Holmes to University of Colorado psychiatrist Dr. Lynne Fenton was seized from the University of Colorado mailroom on July 23, but news reports citing unnamed officers say the notebook included drawings, sketches, and details about the movie theater attack.
Defense attorneys filed two motions, one for each alleged violation of the gag order. They claim the violations affect Holmes’ prospects for a fair trial. The judge overseeing the case has agreed to hold a hearing on the motions October 11, 2012 at 9:00 a.m.
Holmes faces 152 counts of murder and attempted murder for allegedly opening fire in an Aurora, Colorado movie theater during a midnight screening of “The Dark Knight”, killing twelve people.
